Landmark ruling by High court for Devraz Bhairav restoration
In a Landmark ruling, the J&K and Ladakh High Court has mandated the protection of unattended and vulnerable Kashmiri Hindu temples and shrines from encroachments and land mafia. The court directed the district magistrate of Ganderbal to preserve, protect, and maintain two Hindu shrines, 'Asthapan Devraj Bharav' in Nuner village and the 'Videshwar' shrine. This decision follows a petition by Kashmiri Panditsof Nunar who raised concerns about encroachments, particularly on the only Hindu cremation ground in Ganderbal. Justice Sanjeev Kumar's order emphasized the immediate takeover and protection of these properties by the district magistrate, who must remove any encroachments within eight weeks. The expired leases with respondents will not be renewed, and the district magistrate will manage the properties. This judgement sets a precedent for safeguarding many Hindu religious sites in Kashmir that are currently neglected and at risk of illegal occupation.
